Welcome to the Guard Llama family! By subscribing to our service, you accept, without limitation or qualification, these terms and conditions of use. We may change these terms and conditions from time to time, with notice, and you agree to be bound by any such changes. PLEASE READ THIS DOCUMENT CAREFULLY AND KEEP A COPY OF IT IN A SAFE PLACE. IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU. THIS DOCUMENT CONTAINS IN THE PARAGRAPH TITLED “HOW WE WILL RESOLVE DISPUTES: ARBITRATION AGREEMENT, CLASS ACTION WAIVER AND FORUM SELECTION CLAUSE,” AN ARBITRATION AGREEMENT THAT WAIVES YOUR RIGHT TO A JURY TRIAL, AND A CLASS ACTION WAIVER, A CHOICE OF LAW PROVISION, AND A FORUM SELECTION CLAUSE.
How Your Service Works
Guard Llama service is only available in the United States. Guard Llama IS NOT A SUBSTITUTE FOR 911, and in fact, if Guard Llama conferences in 911 emergency services on your behalf, there could be a delay in reaching 911 emergency services. The service will only work if your account is current on payment and if your phone is charged, turned on, has network access, location services turned on, Bluetooth is on, and the Guard Llama Personal Safety Remote enabled. Guard Llama service may not be available in remote or enclosed areas. You agree that once you enroll in Guard Llama service, we will be able to track your approximate location whenever you activate your device and that we can provide this information to third party service providers in case of an emergency or service incident. However, we cannot guarantee that we can track your exact location and in some cases, we may only be able to provide the information provided in your personal profile. We will only use your location information for providing Guard Llama service.
Your Use of Guard Llama Response Service
You promise not to use the Guard Llama service for any fraudulent, unlawful, or abusive purpose, or in any way that interferes with our provision of services to our other customers. If you do any of these things, you agree you will be responsible for any amount anyone else claims from us, plus any expenses, resulting in whole or in part from your actions. You are solely responsible for maintaining the content and accuracy of your personal profile with Guard Llama.
Your Responsibility To Pay For Guard Llama Service
You are responsible to pay for your Guard Llama service on time and (unless the law provides otherwise) in full. If you purchase a year of service in advance and stop your service in the middle of the annual period, you will be responsible for the full cycle of the bill. Billing will terminate at the end of the original scheduled billing cycle. You are also responsible for directly paying all charges for services provided to you by others (such as emergency service providers).
Your Responsibility To Tell Us Right Away About Disputed Charges
If you object to any fees or charges for services, you must tell us in writing within 60 days after the fee or charge is incurred, (unless the law does not allow a limit or the law requires a longer period), or you are waiving the dispute.
Your Responsibility To Pay For Taxes And Government Fees
You promise to pay all federal, state and local taxes, and other fees and service charges that we are required by law to collect and remit to the government on the services we provide to you. These charges may change from time to time without advance notice.
Your Responsibility For Others Who Use Your Guard Llama Service
You are solely responsible for any use of the Guard Llama service associated with your device, even if you are not the one using it, and even if you later claim the use was not authorized. You are also solely responsible for the services requested by you, or by anyone using the service through Guard Llama on your behalf. You agree that our agent may share your information with any authorized person calling the service on your behalf.
Ending Your Guard Llama Service
You can cancel your Guard Llama service at any time. All you have to do is call us and tell us you want to cancel service. We will cancel the service immediately; you will may be charged for any future months or years depending on your plan option.
Reactivating Or Changing Your Guard Llama Service
We will only accept requests from you (or from someone we believe is your authorized agent) to activate, cancel, or reactivate your Guard Llama service. If we do any of these things, you agree to pay any charges associated with these requests. We will attempt to retrieve your previously stored personal profile if you reactivate your Guard Llama service, but we cannot guarantee our ability to retrieve it.
Your Interactions With Guard Llama Agents
We may record and monitor conversations between you and our agents, emergency service providers, the police, or other third parties. Please note that our agents may also remain on the line if they conference in a third party to assist in completing a service request. Please understand that Guard Llama is not required to release any audio or physical records that are created as part of the Guard Llama service without a subpoena (unless otherwise required by law). We will do our best to accommodate you if English is not your first language and you require translation services, but we cannot guarantee the availability or competence of a third party translator.
Connection To Other Service Providers
Our agents may link, conference or transfer to other service providers such as the police, fire department, ambulance service, or 911 emergency services. We’ll use reasonable efforts to contact appropriate service providers for help when you ask for it, but we can’t promise that any service providers will respond in a timely manner or at all.
Furthermore, we can’t promise we will provide the best service provider or guarantee any level of service from such service provider. The laws in some places require an emergency situation to be confirmed before emergency service providers will provide service. We will not contact emergency service providers in these locations in response to your call if we cannot hear your request for assistance or otherwise confirm that an emergency exists. We will attempt to have an agent contact you after you have activated your Guard Llama Personal Safety Remote to make sure that you do need additional assistance before contacting the appropriate authorities.
About The Software
Guard Llama service requires software on your device that we may need or want to change from time to time. We may do this remotely, or through a third party service provider without notifying you first. You do not own the Guard Llama software or acquire any rights to use or modify the Guard Llama software on your own.
Our Right To Terminate Or Suspend Your Guard Llama Service
We may terminate your Guard Llama service without cause, in which case we will give you notice 30 days prior to the effective date of termination after which your account will be deactivated and your service will terminate. This means that we can decide to cease providing the Guard Llama service to you at any time and for any reason, even for reasons unrelated to you or your account with us. In such a case, we will refund any amounts you have paid in advance. Also, we may terminate your service without prior notice to you for any good cause. This means, for example, we can terminate your service immediately if you breach any part of this agreement, don’t pay amounts that are due to us, interfere with our efforts to provide service, interfere with our business, or if your Guard Llama service or wireless phone number is used for illegal or improper purposes. You don’t have any right to have Guard Llama service reactivated, even if you cure any of these problems. Whether we allow you to have service again will be entirely up to us. We can suspend your Guard Llama service for any reason. We can also suspend it for network or system maintenance or improvement, or if there’s network congestion, or if we suspect your service is being used for any purpose that would allow us to terminate it.
Some of our key privacy practices are outlined in this section. For a complete description of our privacy practices, please refer to our Privacy Statement. We may update our Privacy Statement from time to time and the updates are available at www.theguardllama.com, or you can contact us to request a copy. We may collect information about you in several different ways: from information you provide to us, from your use of the Guard Llama service, from calls or emails between us, from location based services, and from third party data providers. We will collect information about your location on a periodic or regular basis.
The information we may get about you includes your contact and billing information (including your credit card number), registration information, your physical locations, and information that helps us customize our services (including your medical conditions and any order(s) of protection). You agree that we can, subject to applicable law, use this information to provide Guard Llama location based services, manage your account, conduct analysis and research, comply with legal requirements, prevent fraud or misuse of the Guard Llama service, and protect our rights or property or the safety of you or others.
We make no representation or warranty, either expressly or tacitly, for the completeness or correctness of the service. The use of the service is at your own risk. Proper functionality of the service requires that your mobile phone is charged, turned on, has network access, location services are turned on, Bluetooth is on and paired with the Guard Llama Personal Safety Remote, with the Guard Llama application running, and the Guard Llama Personal Safety Remote enabled. The service may not function as intended if any of the foregoing conditions are not satisfied or as a result of various other matters outside of Guard Llama’s control, including, without limitation, availability and response time of emergency response personnel in your vicinity or technical conditions (such as your mobile device’s operating system killing the application due to memory pressure from other open applications, the mobile device being in airplane mode, the application being closed or location services disabled by the user, or the battery of Guard Llama Personal Safety Remote is dead), The service may not be available in remote or enclosed areas. Guard Llama agents may link, conference or transfer to other service providers such as the police, fire department, ambulance service, or 911 emergency services. Guard Llama agents shall use reasonable efforts to contact appropriate service providers for help when Members ask for it, but Guard Llama does not warrant that any service providers will respond in a timely manner or at all. We assume no liability for or relating to the delay, failure, interruption or corruption of any voice, call quality, or data transmitted on a device while using Guard Llama. While we strive to ensure that the service is provided without interruption and is accurate and reliable, we make no warranties or representations as to the accuracy, correctness, reliability or otherwise with respect to the service and we assume no liability or responsibility of any kind for omissions or errors in the service.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR THIRD PARTIES’ RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE, AND FREEDOM FROM COMPUTER VIRUS. Specifically, we and our affiliates make no representations or warranties about the accuracy, reliability, completeness including errors or omissions, currentness or timeliness of content, software, text, graphics, links, or communications provided on or through the use of the service.
Limited Warranty for Guard Llama
We warrant to you, if you are the original purchaser of a Guard Llama Personal Safety Remote (the “PSR”), that the PSR is free from defects in material and workmanship under normal use and service for one year from the date of purchase. This Limited Warranty is conditioned upon you properly using the PSR. This Limited Warranty does not cover: (a) defects or damage resulting from accident, misuse, abuse, neglect, unusual physical, electrical or electromechanical stress, or modification of any part of the PSR, or cosmetic damage; (b) equipment that has the serial number removed or made illegible; (c) any plastic surfaces or other externally exposed parts that are scratched or damaged due to normal use; (d) malfunctions resulting from the use of the PSR in conjunction with accessories, products, or ancillary/peripheral equipment we have not furnished or approved; (e) defects or damage from improper testing, operation, maintenance, installation, or adjustment; or (f) installation, maintenance, and service of the PSR. During the applicable warranty period, we, will repair or replace, at our sole option, without charge to you, any defective component part of the PSR. To obtain service under this Limited Warranty, you must return the PSR to us in an adequate container for shipping, accompanied by your account number, sales receipt or comparable substitute proof of sale showing the date of purchase and the serial number of the PSR. To obtain assistance on where to deliver the PSR, call us at 855-423-0066. Upon receipt, we will promptly repair or replace the defective Guard Llama. We, may at our sole option, use rebuilt, reconditioned or new parts or components when repairing any PSR or replace the PSR with a rebuilt, reconditioned or new PSR. Repaired or replaced PSRs will be warranted for a period equal to the remainder of the original Limited Warranty or for 90 days, whichever is longer.
Limitations of Liability
You and Guard Llama are each waiving important rights. Unless forbidden by law in a particular instance, we each agree as follows: (1) we are not liable for the actions or inactions of any service provider we contact for you, or for our inability to contact any service provider in any particular situation, (2) we are not liable to you for any injuries to persons or property arising out of or relating to your use of the Guard Llama service, (3) our maximum liability to you under any theory (including but not limited to fraud, misrepresentation, breach of contract, personal injury, or products liability) is limited to an amount equal to the portion of the charges to you for the services relating to the period of service during which such damages occur, (4) unless otherwise provided in this agreement, your maximum liability to us under any theory (including but not limited to fraud, misrepresentation, breach of contract, personal injury, or products liability) is limited to any charges due and owing by you to us, (5) neither you nor we can recover punitive damages, treble, consequential, indirect, or special damages, or attorney’s fees. You and we agree not to make, and to waive to the fullest extent allowed by law, any claim for damages other than direct, compensatory damages as limited in this agreement, (6) no one is liable to you for dropped calls or interrupted service, or for problems caused by or contributed to by you, by any third party, by buildings, hills, tunnels, network congestion, weather, GPS accuracy and altitude, your mobile phone settings, Guard Llama Remote’s distance from mobile phone or any other things we do not control, (7) notwithstanding anything else in this agreement, you agree to excuse any non-performance by us or any service provider caused in whole or in part by an act or omission of a third party, or by any equipment failure, act of god, natural disaster, strike, equipment or facility shortage, or other causes beyond the control of us or our service providers, (8) you agree that neither we nor any service provider who sends you data or information through Guard Llama is liable for any errors, defects, problems, or mistakes in that data or information, and (9) you agree that the limitations of liability and indemnities in this agreement will survive even after the agreement has ended. These limitations of liability apply not only to you, but to anyone using the Guard Llama service on your behalf, to anyone making a claim on your behalf, and to any claims made by your family, employees, customers, or others arising out of or relating to your Guard Llama service. Some states don’t allow an exclusion or limitation of incidental or consequential damages or certain other damages, so some of the limitations above may not apply in some situations. How We Will Resolve Disputes: Arbitration Agreement, Class Action Waiver and Forum
If you and we have a disagreement related to Guard Llama service or the validity of these terms of conditions of use, we’ll try to resolve it by talking with each other. If it is found our service did not work properly for you, excluding what we cannot control as stated in the limitations of liability, we agree to pay you liquidated damages of $250.
To the fullest extent permitted by law, and except as explicitly provided otherwise, this agreement and any disputes arising out of or relating to it will be governed by the laws of the state of Delaware, in accordance with the Federal Arbitration Act, without regard to its conflict of law principles, and by any applicable tariffs, wherever filed.
Our Relationship With You
This agreement does not create any fiduciary relationships between you and us. It doesn’t create any relationship of principal and agent, partnership, or employer and employee, either.
We Can Assign This Agreement
We can assign this agreement or your obligations to pay under it in whole or in part to anyone we choose. You cannot assign this agreement or your obligations to anyone else without our prior written consent.
This Is The Entire Agreement
This agreement is the entire agreement between you and us. It supersedes all other agreements or representations, oral or written, between us, past or present, and may not be amended except in a writing signed by Guard Llama. If any part of this agreement is considered invalid, the rest of it will remain enforceable. No waiver of any part of this agreement, or of any breach of it, in any one instance will require us to waive any other instance or breach. In some circumstances we might decide to provide you service voluntarily even if you would not otherwise qualify. This will not be a waiver or require us to do so again.

Please read this agreement regarding your service. When you accept this agreement, you’re bound by its conditions. It applies to all of your services from Guard Llama and covers important topics such as:
- How long this agreement lasts
- Your rights to refuse or cancel this agreement
- Our friendly 30-day return policy
- Our rights to limit or end service to this agreement
- Limitations of liability and privacy
- How to handle disputes if they arise, including arbitration
Your Subscription Agreement
The subscription agreement you select is part of this agreement. To the extent any condition in your plan expressly conflicts with this agreement, the condition in your plan will apply.
Your Rights To Refuse Or Cancel This Agreement
After you’ve had an opportunity to review this agreement, it will begin when you do any of the following to indicate your acceptance:
- Activate your service
- Give us a written or electronic signature indicating your acceptance
- Tell us electronically that you accept.
- If you do not wish to accept this agreement, do not do any of the above actions.
Our Friendly 30-Day Return Policy
If for any reason, within 30 days from date of purchase, you are not completely satisfied with your service, we will refund the first month’s service charge, plus applicable taxes provided You return the device in “like new” condition, as determined by Guard Llama, in the original box with all components and materials. The shipping charges are not refundable.
- Please call our Customer Service Department at 844-355-5262, 24 hours a day, 7 days a week, to cancel your account and obtain a return authorization number.
- Approved returns must be shipped back at the customer’s expense in the original packaging.
- Refunds, if applicable, will be processed back to the party that paid in the same manner that payment was received. Please allow 21 business days for processing.
If for any reason you are not completely satisfied with your service and you wish to cancel after the expiration of the initial thirty (30) day period provided above, you’ll be able to do so as described below.
You must call our Customer Service Department at 844-355-5262, 24 hours a day, 7 days a week, to cancel your account. You will receive a final bill that will detail all the charges and credits on your account.
If you wish to cancel your service before the end of a given month or year (depending upon your subscription term), you’ll be responsible for any account charges and overages through the date of your final bill.
Although cancellations are effective immediately, we don’t bill for partial months or year; therefore, you’ll be charged for the entire month or year remaining on your bill cycle.
Charges And Fees
There are no start-up costs associated with Guard Llama. You will be charged on a monthly or annual basis depending on the option you choose.
Taxes, Fees And Assessments
We are required by law to charge you certain taxes, surcharges and assessments that will be included on your bill. You are responsible for paying all taxes, surcharges and assessments associated with your Guard Llama products and services. These may change from time to time, and we may not be able to give you advance notice about how these changes may affect you. Except as prohibited by law, we may also, at our discretion, require you to pay regulatory and administrative fees to recover our costs of complying with regulatory mandates and Universal Service fees or similarly imposed charges. Any customer who is eligible for an exemption from any tax or fee must provide us with a verifiable, valid and properly executed tax-exempt certificate. Any tax exemption applies only after the date we receive the certificate from you and have verified your eligibility for the exemption.
How We Calculate Your Bill
Your bill is our notice to you of your fees, charges and other important information regarding your account. It reflects the fees and charges in effect for your service plan at the time they are incurred. Charges for monitoring will start on the expected delivery date of your Guard Llama Personal Safety Remote and renews automatically based on your chosen billing cycle.
Payments, Deposits, Credit Cards
Payment is due in full as stated on your bill. IF WE DON’T RECEIVE PAYMENT IN FULL WHEN DUE, WE MAY, TO THE EXTENT PERMITTED BY THE LAW OF THE STATE OF THE BILLING ADDRESS WE HAVE ON FILE FOR YOU AT THE TIME, CHARGE YOU A LATE FEE UP TO 1.5 PERCENT A MONTH (18 PERCENT ANNUALLY) OR A FLAT $5 PER MONTH, WHICHEVER IS GREATER, ON UNPAID BALANCES. WE MAY ALSO CHARGE YOU FOR ANY COLLECTION AGENCY FEES BILLED TO US FOR TRYING TO COLLECT FROM YOU. SHOULD WE NOT RECEIVE YOUR PAYMENT, WE MAY SUSPEND YOUR SERVICE UNTIL PAID IN FULL. WE RESERVE THE RIGHT TO CHARGE A REASONABLE RECONNECTION FEE. IF YOUR ACCOUNT REMAINS UNPAID FOR MORE THAN __30___ DAYS, WE WILL CANCEL SERVICE FOR NON-PAYMENT. We reserve the right to require recurring credit card billing for certain products or services. We also reserve the right to require an advance deposit (or an increased deposit) from you based on your payment history and changes in your plan and/or the frequency of use of our services. We’ll pay simple interest on any deposit at the rate the law requires. Please retain your evidence of deposit. You agree that we can apply deposits, payments, or repayments in any order to any amounts you owe us on your account(s). You can’t use a deposit to pay any bill unless we agree.
Service Subject To Change
Your service is dependent upon our business requirements, including policies, practices and procedures, which may change. If there are any material changes to service, Guard Llama will notify you via email or inside the mobile application of the updated terms. Unless otherwise prohibited by law, we can also change prices and any other conditions in this agreement at any time by sending you written notice prior to the billing period in which the changes would go into effect. If you choose to use your service after that point, you’re accepting the changes. If the changes have a material adverse effect on you, however, you can end the affected service, without any early cancellation fee, just by calling us within 60 days after we send notice of the change.
Availability Of Service
Wireless phones use radio transmissions to access service. Therefore, we can’t provide service when your wireless phone is out of range of your provider’s transmission site or if sufficient network capacity is not available. You may not receive service in certain places, particularly in remote areas, with no service at all. Further, your GPS coordinates are as accurate as your service provider allows it to be. We do not control the accuracy of your GPS coordinates. Weather, topography, buildings, your wireless phone, and other conditions that are outside of our control may also cause dropped calls or other problems with your service.
Suspending Service If Your Phone Is Lost Or Stolen
Please notify us immediately if someone steals your phone or you lose it. We’ll be happy to provide a courtesy suspension of service for 30 days or until you choose to replace or recover your phone – whichever comes first. Until we provide a courtesy suspension, you’ll be responsible for all fees and charges, including those related to the use of services, even if used by another party. We may require a sworn statement about the loss or theft.
Our Rights To Limit/End Service Or This Agreement
You agree not to resell our service to someone else without prior written permission from Guard Llama. WE CAN, WITHOUT NOTICE, LIMIT, SUSPEND OR END YOUR SERVICE OR ANY AGREEMENT WITH YOU FOR VIOLATING THIS AGREEMENT OR FOR ANY OTHER GOOD CAUSE, INCLUDING, BUT NOT LIMITED TO:
- Two or more late payments in a 12-month period.
- Incurring charges greater than your required deposit or billing limit (even if we haven’t yet billed the charges) if you are unwilling to increase your deposit with us.
- Incurring charges materially in excess of your monthly access charge (even if we haven’t yet billed the charges).
- Harassing our employees or agents.
- Lying to us.
- Interfering with our operations.
- Becoming insolvent or filing for bankruptcy.
- Breaching this agreement.
- “Spamming,” or other abusive messaging or calling.
- Providing credit information we can’t verify.
- Using your service in a way that adversely affects other customers.
- Allowing anyone to tamper with yourGuard Llama Personal Safety Remote.
We can also temporarily limit your service for any operational or governmental reason.
Disclaimer Of Warranties
WE MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE CONCERNING YOUR SERVICE OR YOUR PHONE. WE CAN’T PROMISE UNINTERRUPTED OR ERROR-FREE SERVICE AND DON’T AUTHORIZE ANYONE TO MAKE ANY WARRANTIES ON OUR BEHALF. THIS DOESN’T DEPRIVE YOU OF ANY WARRANTY RIGHTS YOU MAY HAVE AGAINST ANYONE ELSE. You agree to indemnify, defend and hold Guard Llama harmless from any claims arising out of use of your Guard Llama, breach of this agreement, or violation of any laws or regulations or the rights of any third party by you or any person on your account or that you allow to use your phone, remote, or service.
Waivers And Limitations Of Liability
UNLESS THE LAW FORBIDS IT IN ANY PARTICULAR CASE, WE EACH AGREE TO LIMIT CLAIMS FOR DAMAGES OR OTHER MONETARY RELIEF AGAINST EACH OTHER TO DIRECT DAMAGES. THIS LIMITATION AND WAIVER WILL APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER FRAUD, MISREPRESENTATION, BREACH OF CONTRACT, PERSONAL INJURY, PRODUCTS LIABILITY, OR ANY OTHER THEORY. THIS MEANS THAT NEITHER OF US WILL SEEK ANY INDIRECT, SPECIAL, CONSEQUENTIAL, TREBLE, OR PUNITIVE DAMAGES FROM THE OTHER. THIS LIMITATION AND WAIVER ALSO APPLIES TO ANY CLAIMS YOU MAY BRING AGAINST ONE OF OUR SUPPLIERS, TO THE EXTENT THAT WE WOULD BE REQUIRED TO INDEMNIFY THE SUPPLIER FOR SUCH CLAIM. You agree we aren’t liable for problems caused by you or a third party; by buildings, hills, network congestion, tunnels, weather, your mobile phone settings, Guard Llama Remote’s distance from mobile phone, or other things we don’t control.
Handling Claims With Guard Llama
ANY CLAIMS OR LEGAL ACTIONS ARISING HEREUNDER SHALL BE COMMENCED AND MAINTAINED IN ANY STATE OR FEDERAL COURT OF COMPETENT JURISDICTION LOCATED IN CHICAGO, ILLINOIS, AND YOU CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION AND VENUE OF ANY SUCH COURT. YOU AND WE WAIVE ANY RIGHT TO JURY TRIAL INVOLVING ANY CLAIMS OR DISPUTES BETWEEN YOU AND US. IF WE FIND OUR SYSTEM IS AT FAULT DUE TO ISSUES THAT WERE IN OUR CONTROL, GUARD LLAMA AGREES TO PAY LIQUIDATED DAMAGES IN THE AMOUNT OF $250.
You represent that you’re at least 18 years old and have the legal capacity to accept this agreement. If you are ordering for a friend or a member of your family, you are bound by the terms of this agreement, unless and until, your friend or family member has agreed to the terms of this agreement. If you’re ordering for a company, you’re representing that you are authorized to bind the company to the terms of this agreement, where the context “you” means the company.
About This Agreement
If either of us waives or doesn’t enforce a requirement under this agreement in an instance, we don’t waive our right to later enforce that requirement. You can’t assign this agreement or any of your rights or duties under it. We may assign all or part of this agreement or your debts to us without notice, and you agree to make all subsequent payments as instructed. Notices are considered delivered when we send them by email or fax to any email or fax number you’ve provided to us, or three days after mailing to the most current billing address we have on file for you, if by us, or to the Customer Service address on your most recent bill. If any part of this agreement, including any part of its arbitration provisions, is held invalid, that part may be severed from this agreement. This agreement and the documents to which it refers form the entire agreement between us on their subjects. You can’t rely on any other documents or statements on those subjects by any sales or service representatives, and you have no other rights with respect to service or this agreement, except as specifically provided by law. This agreement isn’t for the benefit of any third party except our parents, affiliates, subsidiaries, agents and predecessors/successors in interest. Except to the extent we’ve agreed otherwise in the provisions on late fees and arbitration, this agreement and disputes covered by it are governed by the laws of the state of Illinois, without regard to the conflicts of the laws or rules of that state.
